เมื่อไม่ได้รับความเป็นธรรมบริษัท b&j จึงเสนอข้อพิพาทต่ออนุญาโตตุลาการเมื่อวันที่ 30 ธันวาคม 2554 อนุญาโตตุลาการได้มีคำวินิจฉัยชี้ขาดเมื่อวันที่ 23 มกราคม 2558 ให้บริษัทดีแอนด์เจชนะคดี โดยวินิจฉัยว่าการเปลี่ยนแปลงเทคโนโลยีไม่ถือว่าเป็นการเปลี่ยนแปลงสาระสำคัญของสัญญาและให้การไฟฟ้าส่วนภูมิภาคชดใช้ค่าเสียหายให้กับบริษัท b&j จำนวน 128 ล้านบาท ซึ่งคำชี้ขาดของอนุญาโตตุลาการดังกล่าวถือเป็นที่สุดผูกพันคู่สัญญา ตามที่ระบุไว้ในสัญญาซื้อขายไฟฟ้า ข้อ 7.5 แต่การไฟฟ้าส่วนภูมิภาคเพิกเฉยมิได้ดำเนินการใดๆ
