ถ้าผู้อุทธรณ์วางเงินต่อศาลชั้นต้นเป็นจำนวนพอชำระหนี้ตามคำพิพากษารวมทั้งค่าฤชาธรรมเนียมในการฟ้องร้องและการบังคับคดี หรือได้หาประกันมาให้สำหรับเงินจำนวนเช่นว่านี้จนเป็นที่พอใจของศาล ให้ศาลที่กล่าวมาแล้วงดการบังคับคดีไว้ดังที่บัญญัติไว้ในมาตรา 295 (1)
