พระราชบัญญัติป่าไม้ พุทธศักราช 2484 มาตรา 54 กำหนดไว้ว่า ห้ามมิให้ผู้ใดก่นสร้าง แผ้วถาง หรือเผาป่า หรือกระทำด้วยประการใดๆ อันเป็นการทำลายป่า หรือเข้ายึดถือ หรือเข้าครอบครองป่าเพื่อตนเอง หรือผู้อื่น ฯลฯ โดยกำหนดโทษสำหรับผู้ฝ่าฝืน คือ มีโทษจำคุกไม่เกิน 5 ปี หรือปรับไม่เกิน 50,000 บาท หรือทั้งจำทั้งปรับ
ในกรณีผู้ใดเผาป่าเป็นเนื้อที่เกิน 25 ไร่ มีโทษจำคุกตั้งแต่ 2-15 ปี และปรับตั้งแต่ 10,000 -100,000 บาท
