5. Communications facilities and communication responsibilities
(1) The Platform Operator and the User Entity are required to keep their communication facilities in operational readiness and to maintain such operational capability in accordance with the state of the art for the duration of this Agreement.
Electronic communication via VW Group Supply.com is accomplished by transmitting messages. Communication within the platform is encrypted. E-mails from applications to systems of the Platform Participant that are external to the platform are not encrypted.
(3) The Platform Operator and the User Entity shall process and reply to all incoming messages without delay, unless the applications specify deadlines.
(4) The parties waive application of the requirements for electronic business transactions contained in § 312e (1) nos. 1-3 and sent. 2 of the German Civil Code.
