Chuyển khẩu được quy định trong Quy

Chuyển khẩu được quy định trong Quy chế này là việc thương nhân Việt Nam mua hàng của một nước để bán cho một nước khác mà không làm thủ tục nhập khẩu vào Việt Nam và không làm thủ tục xuất khẩu ra khỏi Việt Nam.

Phương thức chuyển khẩu được thực hiện dưới các hình thức:

- Hàng hoá được vận chuyển thẳng từ nước xuất khẩu đến nước nhập khẩu không qua cửa khẩu Việt Nam.

- Hàng hoá được vận chuyển từ nước xuất khẩu đến nước nhập khẩu có quan cửa khẩu Việt Nam nhưng không làm thủ tục nhập khẩu vào Việt Nam và không làm thủ tục xuất khẩu ra khỏi Việt Nam.

- Hàng hoá được vận chuyển từ nước xuất khẩu đến nước nhập khẩu có qua cửa khẩu Việt Nam và đưa vào kho ngoại quan, không làm thủ tục nhập khẩu vào Việt Nam và không làm thủ tục xuất khẩu ra khỏi Việt Nam.

Chuyển khẩu được thực hiện trên cơ sở hai hợp đồng riêng biệt: hợp đồng mua hàng do thương nhân Việt Nam ký với thương nhân nước xuất khẩu và hợp đồng bán hàng do thương nhân Việt Nam ký với thương nhân nước nhập khẩu. Hợp đồng mua hàng có thể ký trước hoặc sau hợp đồng bán hàng.

Transfer the password specified in this regulation is the purchase of a Vietnam merchant water to sell to another country without import procedures on to Vietnam and not do the procedure for export out of Vietnam.The method of transfer is done in a form:-Goods to be transported straight from the country of export to the importing countries through the gate not Vietnam.-The goods are transported from the exporter to the related importer gate Vietnam but not the import procedures on to Vietnam and not do the procedure for export out of Vietnam.-The goods are shipped from the country of export to the importing countries through the gate and Vietnam take on bonded, no customs imported into Vietnam and not do the procedure for export out of Vietnam.Transfer is made on the basis of two distinct contracts: the contract of purchase by Vietnam traders signed with the trader and exporter sales contract signed by Vietnam traders Traders importing States. The purchase contract can be signed before or after the contract of sale.

The method transshipped be implemented in the following forms: - Goods are shipped directly from the exporting country to an importing country does not cross the border of Vietnam. - Goods are shipped from the exporting country to an importing country has the gate Vietnam without procedures for import into Vietnam and the procedures for export from Vietnam. - Goods are transported from exporting countries to importing countries through border gates of Vietnam and put into bonded warehouses , without procedures for import into Vietnam and the procedures for export from Vietnam. Transit is done on the basis of two separate contracts: purchase contracts signed by Vietnam trader with foreign traders export and sales contracts signed by Vietnam trader traders importing countries. The purchase contract may be signed before or after the contract of sale.
