อาเซียนและสหภาพยุโรปได้เจรจาความตกลงการค้าเสรีระหว่างกันตั้งแต่ปี พ.ศ.2550 โดยความตกลงดังกล่าว มีสาระสำคัญครอบคลุมการเปิดตลาดสินค้า การค้า ภาคบริการ และการลงทุน รวมทั้งความร่วมมือในด้านต่างๆ ในปัจจุบันการเจรจาจัดทำความตกลงการค้าเสรีระหว่างอาเซียนกับสหภาพยุโรปอยู่ระหว่างพักการเจรจา เนื่องจากความเห็นที่แตกต่างกันในเรื่องระดับการเปิดตลาด ประกอบกับระดับการพัฒนาที่ยังแตกต่างกันมาก ทั้งภายในประเทศสมาชิกอาเซียนและระหว่างกลุ่มอาเซียนกับสหภาพยุโรป ดังนั้นสหภาพยุโรปจึงได้เปลี่ยนแนวทางการเจรจาเป็นแบบทวิภาคีกับประเทศที่พร้อมก่อน 3 ประเทศโดยสนใจเจรจากับสิงคโปร์ เวียดนาม และไทย ซึ่งสหภาพยุโรปแสดงความสนใจที่จะเจรจากับไทยมาอย่างต่อเนื่อง
เมื่อพิจารณาจากร่างเนื้อหาการเจรจาในกรอบความตกลงการค้าเสรีอาเซียน-สหภาพยุโรป พบว่า ประเด็นที่เกี่ยวข้องกับการเข้าถึงยา คือ การขอขยายระยะเวลาการคุ้มครองสิทธิบัตร ซึ่งเป็นลักษณะที่เกินกว่าข้อตกลงพหุภาคีภายใต้องค์การการค้าโลกว่าด้วยสิทธิในทรัพย์สินทางปัญญาที่เกี่ยวกับการค้า (TRIPS Agreement) หรือเรียกว่า TRIPS-plus ซึ่งเป็นไปในทิศทางเดียวกับความตกลงการค้าเสรีไทย-สหรัฐอเมริกาที่ส่งผลกระทบโดยตรงต่อการเข้าถึงยาของประชาชน เพื่อให้ไทยสามารถกำหนดนโยบาย ยุทธศาสตร์ แนวทางในการเจรจาที่ก่อให้เกิดประโยชน์สูงสุดกับประเทศ และสอดคล้องกับมาตรา 190 ของรัฐธรรมนูญแห่งราชอาณาจักรไทยพุทธศักราช 2550 ซึ่งส่งผลให้ภาครัฐจะต้องดำเนินการด้วยความรอบคอบ ส่งเสริมการมีส่วนร่วมจากทุกภาคส่วน และดำเนินการศึกษาผลกระทบด้านสุขภาพจากการจัดทำความตกลงการค้าเสรีทวิภาคีระหว่างไทย-สหภาพยุโรป ตามหลักเกณฑ์และวิธีการประเมินผลกระทบด้านสุขภาพ กรณีการกำหนดนโยบายสาธารณะ และการดำเนินกิจกรรมด้านการวางแผนพัฒนา ดังนั้น จึงมีความจำเป็นในการเตรียมข้อมูลโดยใช้กระบวนการประเมินผลกระทบด้านสุขภาพแบบสมบูรณ์เพื่อนำไปสู่การกำหนดท่าทีการเจรจาต่อไป ในทำนองเดียวกัน สำนักงานคณะกรรมการอาหารและยา กระทรวงสาธารณสุข ในฐานะที่เป็นผู้กำกับดูแลความปลอดภัยของผลิตภัณฑ์สุขภาพ และสำนักงานคณะกรรมการสุขภาพแห่งชาติ ได้มีความตกลงร่วมมือในการดำเนินงานประเมินผลกระทบด้านสุขภาพ จากความตกลงการค้าเสรีไทย-สหภาพยุโรปนี้ ตามขั้นตอนในการประเมินผลกระทบด้านสุขภาพแบบสมบูรณ์
