เมื่อครบกำหนดระยะเวลา 548 วัน นับตั้งแต่วันที่ผู้ว่าจ้างได้ตรวจรับมอบงานงวดสุดท้ายเป็นที่เรียบร้อยแล้ว หรือ เมื่อสัญญาเป็นอันยกเลิกโดยไม่ใช่ความผิดของผู้รับจ้าง ผู้ว่าจ้างตกลงจะคืนเงินประกันดังกล่าวเฉพาะส่วนที่เหลือ ภายหลังจากหักค่าใช้จ่าย หรือ ค่าเสียหาย ที่เกิดขึ้น (ถ้ามี) แก่ผู้รับจ้างโดยปราศจากดอกเบี้ย
