Setelah hakim memutuskan bahwa pengajuan tata cara gugatan perwakilan kelompok dinyatakan sah, hakim memerintahkan kepada penggugat/pihak yang melakukan class action untuk mengajukan usulan model pemberitahuan untuk memperoleh persetujuan hakim. Setelah usulan model tersebut disetujui oleh hakim maka penggugat dengan jangka waktu yang ditentukan oleh hakim melakukan pemberitahuan kepada anggota kelompok.

Pemberitahuan kepada anggota kelompok adalah mekanisme yang diperlukan untuk memberikan kesempatan bagi anggota kelompok untuk menentukan apakah mereka menginginkan untuk ikut serta dan terikat dengan putusan dalam perkara tersebut atau tidak menginginkan yaitu dengan cara menyatakan keluar (opt out) dari keanggotaan kelompok.
