Đối với bên B trong trường hợp giao

Đối với bên B trong trường hợp giao hàng chậm:
Mức phạt được tính như sau: Nếu Bên B bàn giao thiết bị cho bên A chậm thì:
- Bên B sẽ phải chịu phạt 0.5% tổng giá trị hợp đồng cho 1 ngày chậm trễ. Mức phạt tối đa không vượt quá 5% tổng giá trị hợp đồng và không quá 10 ngày làm việc.
- Trường hợp Bên B giao hàng chậm trên 10 ngày, Bên A có quyền đơn phương chấm dứt hợp đồng. Bên B có trách nhiệm hoàn trả lại số tiền mà bên A đã thanh toán trong đợt 1 đồng thời yêu cầu bên B bồi thường những thiệt hại phát sinh nếu có.
