As you know full well, and per records here in attachment, all the valves have been tested successfully in the presence of your appointed TPI, RINA.
Valves were dispatched and delivered to you in perfect, no leakages conditions, as witnessed by your Inspectors.
We analyzed the reports received from Masterpac (attached to your mail), but unfortunately these docs did not help to let us understand the causes (and in some cases not even the effects) of the leakage you claimed, and which Masterpac was called upon to resolve, replacing some parts and cleaning up.
Reports indicate only that after gas test a leakage occurred, without specifying the conditions under which the tests were performed and the specs/mode of the test itself.
Therefore, we cannot assess the issues and we assume no responsibility for the leakage.
As said before, factory tests were performed according to customer’s specs. Tests and results were analyzed and witnessed by customer appointed TPI and velves were packed and released with no issue or leakage.

In conclusion:
1. Fluitek bears no responsibility on the leakage occurred, the circumstances and causes cannot be analyzed due to the lack of information
2. Fluitek bears no saying on the actual decision to repair the valves at Masterpac. This is a decision that can only be taken by TNS
3. Costs for the repairs will be solely TNS’ responsibility. Fluitek is only liable for defects of the product under warranty.
4. Fluitek, recognizing the partnership with TNS, will exceptionally keep warranty validity, even though the intervention on the valve was not overviewed by Fluitek’s technicians and some of the replaced parts are not original manufacturer’s spares.
