I refer to the site inspection held on the 29 June 2015 and I am at a loss to know why i was invited to inspect the site as quite clearly the site is no where near complete.
I would remind you of Clause 4.4 which states:
"The Purchaser agrees to accept the transfer of the title to the Condominium Unit only if the Seller has caused a proper and complete construction of the Condominium building and the Condominium Unit.”
The Condominium Building is not only incomplete it represents a danger to the public entering into it, from the start of the visit the follow is blatantly not finished.
1. Car Park; this is still a building site and required my car to put into valeting the following day to wash off all the mud.
2. Entrance area, not safe the whole area is covered in scaffolding and major building works still being carried out including re-bar and concrete works.
3. Main Construction Hoists still in operation, no safe serration between public and construction works.
4. Lifts/Elevators not working for public use.
I have photographic evidence of all the both.
Following my visit I am of the opinion there is an absolute minimum of 4 months work, more likely 6 months, before the building can be safely accessed by the public and I have to advise you that all the conditions of my delay claim dated 18 June 2015 still apply.
My costs for this abortive visit is THB 4,500 and this will be added to my delay claim.
