กฎหมายที่มีเนื้อหาไม่ดี ไม่ยุติธรรม อาจเกิดขึ้นได้จากกระบวนการออกกฎหมาย กฎหมายที่ตราขึ้นโดยเพื่อประโยชน์ของบุคคลเพียงบางกลุ่ม หรืออาจจะเกิดขึ้นจากการมองข้ามเงื่อนไขทางสังคม เนื่องจากเงื่อนไขทางสังคมที่แตกต่าง การนำกฎหมายที่ถูกกำหนดโดยคณะบุคคลเพียงไม่กี่คนและ ต้องนำไปบังคับใช้ครอบคลุมทุกคนในสังคมนั้นย่อมก่อให้เกิดปัญหาอย่างหลีกเลี่ยงไม่ได้
